Terms of Service

1. The service
This platform is operated by IME Watchdog, Inc. to manage independent medical examination (IME) advocacy services: appointment requests, scheduling, observation staffing, document handling, and billing. Access is by invitation to client law firms and to IME Watchdog staff. By using the platform you agree to these terms on behalf of yourself and, where applicable, the firm you represent.
2. Accounts and acceptable use
- Keep your credentials confidential; you are responsible for activity under your account.
- Submit only information you are authorized to share, and keep it accurate.
- Access only records belonging to you or your firm.
- Do not attempt to probe, disrupt, or circumvent the platform’s security, rate limits, or access controls.
3. Bookings, fees, and payment
Appointment requests, cancellations, rescheduling, and associated fees (including surcharges such as weekend, late-booking, travel, transportation, and language-assistance fees) are governed by your firm’s service agreement with IME Watchdog and the cancellation policy in effect at booking time. Where your firm has authorized automatic charging, cards on file are charged per that authorization; invoices otherwise fall due on their stated terms. Payment card data is processed by Authorize.net under its own terms.
4. SMS text messaging
Where an examinee or user opts in, we send transactional text messages about IME appointments (confirmations, reminders, cancellations, and reschedules) through our provider, Twilio. Message frequency varies with appointment activity, and message and data rates may apply. You can opt out at any time by replying STOP to any message, or reply HELP for help. Opting out of texts does not affect the underlying appointment or a firm’s ability to use the platform. How mobile numbers and consent are handled is described in our Privacy Policy.
5. Documents and data
Firms retain their rights in documents and case information they submit. You grant IME Watchdog permission to store and process that material to provide the service, as described in our Privacy Policy. The platform, its software, and its content are the property of IME Watchdog and its licensors.
6. Service changes and availability
We may update, suspend, or discontinue features of the platform, and may suspend accounts that violate these terms or create risk to the service or other users. We aim for high availability but the platform is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law.
7. Liability and disputes
To the maximum extent permitted by law, IME Watchdog’s aggregate liability arising out of the use of this platform is limited to the amounts paid by your firm for the services giving rise to the claim in the twelve months preceding it. Nothing in these terms limits liability that cannot be limited by law. Your firm’s service agreement controls where it conflicts with these terms. These terms are governed by the laws of the State of New York.
